1. Introduction

Welcome to the Sunshine Kids Art Club website (the "Site"). These Terms of Use govern your access to and use of the Site, including class browsing, registration inquiries, and online booking.

By accessing or using the Site, or by booking a class through the Site, you agree to these Terms of Use. If you do not agree, please do not use the Site.

This Site is intended for use by parents, legal guardians, and other adults who are at least 18 years old. Children should not use the Site on their own.

2. About the Site

Sunshine Kids Art Club provides information about children’s art classes, programs, policies, and related services. The Site also allows parents and guardians to register for classes and submit payment through our third-party payment processor.

3. Eligibility

You may use this Site only if you are legally able to enter into a binding agreement and are at least 18 years old. By using this Site or registering a child for a class, you represent that you are the child’s parent or legal guardian, or that you have authority to act on the parent’s or legal guardian’s behalf.

4. Booking and Payment

Class registration and payment are processed through third-party payment providers, including Stripe. By making a booking, you agree to:

  • provide current, complete, and accurate information;

  • pay all fees, charges, and applicable taxes associated with your booking; and

  • comply with any applicable terms of the third-party payment processor.

Sunshine Kids Art Club does not store full payment card numbers on its own systems.

Bookings may also be subject to separate refund, cancellation, rescheduling, attendance, and classroom policies posted on the Site.

5. No User-Generated Content or Accounts

This Site does not offer public accounts, forums, message boards, reviews, or other user-generated content features. You may submit information only as requested for booking, inquiries, or other direct communication with us.

6. Permitted Use

You may use the Site only for personal, non-commercial purposes related to learning about our programs or booking services for your family.

You may not:

  • use the Site for any unlawful, fraudulent, or misleading purpose;

  • attempt to interfere with the Site’s operation or security;

  • copy, scrape, reproduce, republish, distribute, or exploit Site content without prior written permission;

  • attempt to gain unauthorized access to any part of the Site, server, or connected systems; or

  • use any robot, spider, scraper, or similar automated means to access the Site except standard search engine indexing.

7. Intellectual Property

All content on the Site, including text, graphics, logos, photographs, artwork, class descriptions, branding, layouts, and other materials, is owned by or licensed to Sunshine Kids Art Club and is protected by United States intellectual property laws.

Except for limited personal, non-commercial use, no portion of the Site may be copied, modified, distributed, displayed, published, sold, licensed, or otherwise used without our prior written permission.

8. Health and Safety Information

Parents and guardians are responsible for informing Sunshine Kids Art Club of any allergies, sensitivities, medical conditions, behavioral concerns, accessibility needs, or other information reasonably necessary to support a child’s safe participation.

Our classes may involve art supplies, sensory materials, tools, and natural items such as leaves, flowers, sticks, fruit, vegetables, seeds, or similar materials. While we take reasonable care in selecting materials and supervising activities, participation in children’s art activities carries inherent risks, including mess, spills, minor cuts, allergic reactions, and other ordinary risks associated with hands-on learning.

9. Assumption of Risk

By registering a child for a class, you acknowledge that participation in art and sensory activities involves inherent risks that cannot be completely eliminated. You voluntarily assume those ordinary risks on behalf of yourself and your child, except to the extent caused by gross negligence or willful misconduct where a waiver is not enforceable under applicable law.

10. Third-Party Services and Links

The Site may include integrations, services, or links provided by third parties, including payment processors, map providers, analytics providers, or scheduling tools. We do not control and are not responsible for the content, policies, availability, or practices of third-party services.

Your use of third-party services is governed by the terms and privacy policies of those third parties.

11. Disclaimer of Warranties

The Site and all content, materials, and services made available through it are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, Sunshine Kids Art Club disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

12. Limitation of Liability

To the fullest extent permitted by law, Sunshine Kids Art Club and its owners, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, any inability to use the Site, any third-party service, or any booking made through the Site.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Site will not exceed the greater of (a) the amount you paid to Sunshine Kids Art Club through the Site for the specific transaction giving rise to the claim, or (b) one hundred U.S. dollars ($100).

Nothing in these Terms limits liability to the extent such limitation is prohibited by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sunshine Kids Art Club and its owners, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to:

  • your misuse of the Site;

  • your violation of these Terms;

  • information you submit through the Site; or

  • your child’s participation in classes, except to the extent caused by the gross negligence or willful misconduct of Sunshine Kids Art Club where indemnification is not enforceable under applicable law.

14. Privacy

Your use of the Site is also subject to our Privacy Policy, which describes how we collect, use, and share information.

15. Changes to These Terms

We may update these Terms of Use from time to time. Updated versions will be posted on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

16. Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

Except where otherwise required by law, any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the personal jurisdiction of those courts.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
