Participation Waiver and Release of Liability

Please read carefully. This document affects your legal rights.

In consideration of my child’s participation in classes, camps, workshops, events, and related activities offered by Sunshine Kids Art Club (collectively, the "Activities"), I agree as follows:

1. Acknowledgment of Activities and Risks

I understand that the Activities may include painting, drawing, cutting, gluing, sensory play, sculpting, printmaking, working with natural materials, and other hands-on creative activities conducted indoors or outdoors.

I understand that participation may involve inherent risks, including but not limited to slips, falls, minor cuts, splinters, allergic reactions, contact with art and natural materials, and other risks associated with children’s group activities.

2. Health Information

I certify that I have disclosed any known allergies, sensitivities, medical conditions, behavioral concerns, accessibility needs, or other information that may affect my child’s safe participation.

I understand that it is my responsibility to keep this information current.

3. Assumption of Risk

To the fullest extent permitted by law, I knowingly and voluntarily assume the ordinary risks associated with my child’s participation in the Activities on behalf of myself and my child.

4. Release of Liability

To the fullest extent permitted by California law, I release and discharge Sunshine Kids Art Club and its owners, employees, instructors, assistants, contractors, volunteers, and agents from claims, demands, damages, or causes of action arising out of ordinary negligence relating to my child’s participation in the Activities.

This release does not apply to gross negligence, reckless conduct, or willful misconduct, or to any other liability that cannot be waived under applicable law.

5. Emergency Medical Care

In the event of a medical emergency, I authorize Sunshine Kids Art Club to seek emergency medical care for my child if I cannot be reached promptly. I understand that I am financially responsible for any resulting medical treatment, transportation, or related costs.

6. Rules and Conduct

I understand that Sunshine Kids Art Club may establish health, safety, and behavioral rules for participation. I agree that my child and I will follow those rules. I understand that a child may be removed from an Activity when necessary for safety, well-being, or program operation.

7. Personal Property

I understand that Sunshine Kids Art Club is not responsible for lost, stolen, or damaged personal property.

8. Photography and Media

Photography and media permissions are addressed separately in the Photo and Media Release below. Unless I sign that release or otherwise provide clear written consent, my child’s image may not be used for promotional purposes.

9. Governing Law

This Agreement shall be governed by the laws of the State of California.

10. Severability

If any portion of this Agreement is found unenforceable, the remaining portions shall remain in effect to the fullest extent permitted by law.

I have read this Participation Waiver and Release of Liability, understand it, and agree to it voluntarily.

Photo and Media Release

I grant Sunshine Kids Art Club permission to photograph, film, or otherwise capture my child’s image, artwork, voice, or first name in connection with classes, workshops, camps, and related activities.

I understand that these materials may be used for lawful promotional and educational purposes, including:

  • the Sunshine Kids Art Club website;

  • social media;

  • brochures and flyers;

  • email newsletters; and

  • other marketing materials.

I understand that:

  • no compensation will be provided for such use;

  • Sunshine Kids Art Club may edit, crop, or format images or recordings;

  • my child’s full name, home address, school name, or other sensitive personal information will not be published without separate consent; and

  • I may revoke this permission for future use by contacting Sunshine Kids Art Club in writing, but revocation will not apply to materials already published or distributed.
